Please read these General Terms carefully before using the website “fjk-no1.hr”. Giana d.o.o. provides a sales service through the mentioned site – fjk-no1.hr web store. By using the fjk-no1.hr web store service and all associated pages and services on the www.fjk-no1.hr domain, it is considered that consumers are at all times familiar with these Terms of Sale (hereinafter: Terms), and that they fully understand and accept them.

These Terms apply to the rights and obligations related to the purchase of products or services through the fjk-no1.hr web store, as well as the rights and obligations arising from the conclusion of a Distance Sales Contract (hereinafter: Contract) between the consumer as the end buyer and the fjk-no1.hr web store, and are considered an integral part of such contracts.

If you do not agree with these General Terms, please do not use this website for the purpose of purchasing products or obtaining information about them.

Users are advised to familiarize themselves with these Terms before each purchase and to check them regularly, in order to be aware of all their rights and obligations.

All matters not explicitly regulated by these General Terms are governed by the Consumer Protection Act and the Civil Obligations Act of the Republic of Croatia, as well as other applicable regulations.

1. GENERAL PROVISIONS OF THE TERMS OF SALE

I. DEFINITIONS OF TERMS USED IN THESE GENERAL TERMS

1. Seller – the company Giana d.o.o., OIB: 54809880189, Grada Chicaga 27, 10000 Zagreb, which operates retail of “food products, canned goods…” under the name “FJK-No1”

2. “fjk-no1.hr” – a website owned by the Seller

3. Buyer – any person who, after reviewing and selecting products, has registered their information and placed an order

4. Users of “fjk-no1.hr” – any person who uses the “fjk-no1.hr” website to purchase advertised products or obtain information about a specific product

5. Use of “fjk-no1.hr” – accessing the www.fjk-no1.hr site to obtain information about its content and/or to make purchases via the online store

6. Online purchase or web store – purchasing products via “fjk-no1.hr”

7. Products – all products displayed on “fjk-no1.hr” that can be purchased through the web store

All rights to the fjk-no1.hr website are held by the company Giana d.o.o. The provider of the online sales service via the fjk-no1.hr web store is Giana d.o.o., Grada Chicaga 27, 10000 Zagreb, Croatia, OIB: 54809880189, MBS: 04008073, VAT number: HR 54809880189, registered at the Commercial Court in Zagreb, with a fully paid share capital of 20,000.00 HRK.

II. GENERAL PROVISIONS

1. These General Terms of Online Purchase (hereinafter: General Terms) regulate the relationships between Users of “fjk-no1.hr”, Buyers, and the Seller regarding the conditions and method of ordering products, product prices, payment methods, warranties, complaints and returns, delivery, protection of personal data confidentiality, and other matters related to the use of “fjk-no1.hr” and online purchases.

2. The sales contract between the Buyer and the Seller is concluded at the moment the product is ordered.

3. Products can be purchased via “fjk-no1.hr” within the territory of the Republic of Croatia and the Republic of Slovenia, which implies delivery of purchased products exclusively within that area.

4. By using “fjk-no1.hr”, it is considered that the user is familiar with these General Terms and accepts them. The Seller disclaims any responsibility for disputes that may arise due to the User of “fjk-no1.hr” not having read the General Terms.

5. The Buyer can only be an adult and legally competent person. Contracts on behalf of minors and fully legally incompetent persons may be concluded by their legal representatives or guardians, and partially competent persons may conclude contracts only with the consent of their legal representatives or guardians. The Seller bears no responsibility for actions contrary to this provision.

6. Users of “fjk-no1.hr” are required to provide accurate, valid, and complete personal data when filling out the registration form. Failure to do so authorizes the Seller to deny such users access to or use of all or part of the services offered by “fjk-no1.hr”.

7. The Seller is authorized, without prior notice, to change the content of these General Terms, product assortment, prices, and other data related to the web store, as well as all other content on “fjk-no1.hr”. Therefore, Users of “fjk-no1.hr” are required to review the content of the website, especially the General Terms, during each visit. Failure to do so releases the Seller from any responsibility.

8. The Seller disclaims all responsibility for damage that may occur to devices used to access “fjk-no1.hr” and data stored on such devices during use of “fjk-no1.hr” if caused by unlawful actions of third parties, computer viruses, etc., and other circumstances for which the Seller is not responsible. The Seller is also not liable in case of circumstances that prevent the use of “fjk-no1.hr” or online sales.

9. The Seller reserves the right to change, restrict, or discontinue the fjk-no1.hr web store service at any time without prior notice, including partial or complete restriction of access and provision of certain services to users who violate these Terms and the General Terms of Use.

10. The Seller fully disclaims any responsibility for the accuracy and/or completeness of all information and content found on www.fjk-no1.hr. The fjk-no1.hr web store reserves the right to errors in product descriptions and images.

11. The Seller does not guarantee that product photos fully match the actual appearance of the product. We are not responsible for any unintentional errors in product descriptions. Differences between the actual product and the product photo or description on this site are possible if the manufacturer changes any characteristics or content of the product. All descriptions are regularly and thoroughly checked.

2. TERMS OF SALE

I) Conclusion and Termination of the Sales Contract

A) Conclusion of the Sales Contract:

These Terms, as well as specific sales conditions indicated alongside product information, represent an offer by Giana d.o.o. to conclude a Contract. The user, as the buyer, accepts this offer by registering, placing an order, or in another manner defined by these Terms, thereby concluding a Contract between the user and Giana d.o.o. under the conditions stated herein.

The subject and commercial purpose of the Contract is the purchase of a selected product or service via the fjk-no1.hr web store, with payment of the appropriate fee – the price of the product or service. The Contract is concluded through remote communication means (a distance contract) via online sales.

The Contract becomes effective and binding from the moment the user accepts the offer by selecting payment and completing the order as a user of the fjk-no1.hr web store.

B) Termination of the Sales Contract:

1. The buyer may unilaterally terminate the Contract within 14 (fourteen) days without stating a reason.

2. The buyer does not have the right to unilaterally terminate the Contract: – if the service has been fully performed and the performance began with the buyer’s explicit prior consent and acknowledgment that they are aware they will lose the right to terminate once the service is fully performed, – if the subject of the Contract is goods that, due to their nature, have been inseparably mixed with other items after delivery, – if the purchase falls under Article 72 of the Consumer Protection Act, in accordance with Article 79, points 4 and 12 of the same Act.

3. To exercise the right to unilateral termination, the buyer must notify Giana d.o.o. of their decision before the deadline via an unequivocal statement sent by mail (to Giana d.o.o., Grada Chicaga 27, 10 000 Zagreb), or by email to giana@giana.hr, including their full name, address, phone number, or email address. They may also use the provided written form for unilateral termination.

Additionally, the form for unilateral termination (clicking the link leads to the form) may be completed and sent electronically, in which case Giana d.o.o. will promptly confirm receipt of the termination notice via email.

4. The deadline for unilateral termination is 14 (fourteen) days from the day the buyer or a third party designated by the buyer, who is not the carrier, takes possession of the goods, or in the case of services, from the date of contract conclusion.

5. If the buyer unilaterally terminates the Contract, a refund will be issued for the amount received, without delay and no later than 14 (fourteen) days from the date Giana d.o.o. receives the buyer’s termination notice. The refund will be made to the current/giro account specified in the termination notice. Giana d.o.o. may issue the refund only after the goods are returned or proof of return is provided.

6. The buyer must return or send the goods to Giana d.o.o., fjk-no1.hr, Grada Chicaga 27, 10000 Zagreb without undue delay, and in any case no later than 14 (fourteen) days from the date they notified Giana d.o.o. of the termination. The buyer bears the direct cost of returning the goods. Before terminating the Contract, the buyer is advised to call 01 4622 217 or email giana@giana.hr for instructions on returning the goods.

7. The buyer is responsible for any reduction in the value of the goods resulting from handling, except for what was necessary to determine the nature, characteristics, and functionality of the goods.

If the service began at the buyer’s request during the termination period, the buyer must pay Giana d.o.o. an amount proportional to what was delivered up to the moment the termination notice was sent.

II) Conditions and Purchase Procedure

The main characteristics of the products, usage instructions, prices, special offers and benefits, payment and delivery methods apply to those valid at the time the order is placed. These details are listed with each product.

The product price, including VAT, is visible in the shopping cart before the order is finalized, in accordance with the Consumer Protection Act. Delivery costs may also be shown elsewhere on the site and are calculated separately.

All purchase confirmation information based on the electronic order will be sent to the buyer’s email address provided during the order process or in the shopping cart when entering data to finalize the order. All prices are expressed in euros (EUR) and include VAT.

The seller may, in accordance with the Consumer Protection Act, define special sales conditions or forms of sale, which will be clearly indicated with the product or product group or on the website.

If the buyer does not receive a confirmation email, it is possible they entered their email address incorrectly. In that case, the buyer should contact us at giana@giana.hr or call 01 4624 217 so our customer service can verify whether the order was received. Purchase Procedure:

Online purchases can be made by registering at the designated place on “fjk-no1.hr”. When completing the registration form, the buyer must provide accurate, valid, and complete personal data. The buyer may choose to receive notifications from the Seller about new products, promotions, etc. (newsletter).

1. Selecting the desired product is done by saving it to the “cart” by clicking the “Add to cart” link. If the product is accompanied by the text “Only x items in stock (can be pre-ordered)”, it means the Seller has a maximum of x units of that product in stock. By clicking the link, the Buyer receives information about the current status of the product. If the Buyer purchases a product that has already been sold in the meantime, the Seller will contact the Buyer to arrange further action (refund, purchase of another product, or delivery of the same type of product once restocked). Apart from this obligation, the Seller is not liable to the Buyer in the described case on any grounds.
2. The “cart” contains all products selected by the Buyer for purchase, along with the product price, delivery cost, and total price (including VAT). If the Buyer wishes to proceed with the purchase, they select the “Proceed to payment” link, and the system automatically redirects them to the “Payment Information” page, where they must confirm the data provided during registration, delivery address, confirm or modify invoice delivery, and select the payment method (bank transfer or credit card). Invoice details may vary depending on whether the recipient is an individual or a legal entity. If the invoice is for a legal entity, the Buyer must enter all required information.
3. After completing the above steps and selecting “Order” on the “Payment Information” page, the system redirects the Buyer to the “Order” page, which displays an overview including the order number, delivery address, and selected payment method.

   1. Select a product category from the main menu.
2. Selecting products using the search form
   2. Use the search form to enter a keyword. From the list of results, select the product you want.

   3. Select the desired product from the list in the chosen category.
   4. Use filters to choose search criteria. This helps you easily find the desired products.

   18. Read and confirm that you have read the “General Terms of Sale”.
   19. Select “Order” to complete your purchase and review the details.
   20. You will receive an order confirmation at the email address provided during registration.

III) Delivery and Delivery Conditions

Delivery is available only within the Zagreb area, in zones marked on the map.

• The delivery cost is calculated automatically during product purchase and included on the invoice, which shows the product price and delivery fee.
• The delivery cost will be displayed in the cart alongside the product price.
• For products marked as in stock, the delivery time within Zagreb is up to 7 working days from the date the order is confirmed for processing, except for products with special notes.
• If there is a change in delivery time or any other important circumstance affecting the order, our customer service will notify the buyer immediately.

Pickup at Store

• Delivery to a Juice Box store is completely free for all orders.
• The buyer picks up the products in person at the store address selected in the order note in the web shop.

IV) Complaints and Objections

Ordered products are packed to prevent damage during normal handling in transport/delivery.

If the buyer receives a product different from the one ordered, they are entitled to receive the correct product, or if that is not possible, a refund of the product price, delivery fee, and return shipping costs.

In accordance with Article 10 of the Consumer Protection Act, complaints regarding product defects (with order number, invoice number, attached photo of the product, and description of the defect) and all other objections can be submitted in writing via email or regular mail:

In case of a justified complaint, the contract may be terminated with a refund or product replacement. If the issue involves damage and/or defect of the delivered goods, the buyer must send a photo of the complaint for it to be accepted as physical evidence.

The fjk-no1.hr web shop will collect the damaged, defective, or incorrectly delivered goods at its own expense if the complaint is justified and the buyer did not cause the defect, damage, or issue. In such cases, the cost of replacing the product is fully covered by fjk-no1.hr.

If there is a dispute over the validity of the complaint and/or the method of return (the product must be unused, in unchanged quantity, in original packaging, with the original invoice and warranty if applicable), the product will be examined by an expert or authorized legal entity.

If the complaint and subsequent examination occur within 6 months of product delivery to the buyer, the cost of the examination will be fully covered by fjk-no1.hr, regardless of the outcome. If the complaint is justified, all costs of replacement and examination are covered by fjk-no1.hr. If the complaint is unjustified and submitted after 6 months, the buyer will bear the cost of the examination.

The seller is liable for material defects in accordance with the Civil Obligations Act, for complaints submitted within legal deadlines.

In case of a dispute between the seller and the buyer, the buyer may seek out-of-court resolution in accordance with the Consumer Protection Act.

The seller will accept the return of damaged, defective, or incorrectly delivered goods at its own expense if the complaint is justified and the buyer did not contribute to the defect or damage.

In case of a justified complaint, the cost of replacing the product with a new one is fully covered by the seller.

V) Payment Method and Procedure

The buyer is obliged, under threat of losing the right to future complaints, to check the delivered package and invoice, and immediately report any discrepancies to the delivery service. Late complaints will not be accepted.

If we mistakenly listed a product at too low a price, we are not obligated to deliver it at that incorrect price if we notify you before shipping. In such cases, we reserve the right to cancel your order. If your order is canceled, we will refund the full amount paid, including any applicable fees.

Ordered products can be paid online in a single installment using one of the following cards:

The fjk-no1.hr web shop uses Monri Payments for online transactions. Monri Payments is a secure system for real-time payments using credit and debit cards and other payment methods.

Paypal

PayPal is considered the safest method of online payment.

VI) Data Protection During Purchase

The seller commits to respecting the anonymity and privacy of users and will use and process data solely for the purposes defined in these Terms.

The seller may collect personal data from users/buyers, such as name, address, OIB, phone number, or email address, only if voluntarily provided by the user.

The seller will use this data exclusively to fulfill contractual obligations and better understand individual needs, habits, and requirements of users, as well as to improve and enhance service quality.

The seller collects, processes, and publishes data about users related to the use of the fjk-no1.hr web shop without revealing the identity or personal data that could identify users.

The seller collects and records data about the user's IP address or computer location for system administration, troubleshooting, content delivery confirmation, or technical service improvement.

The seller will automatically record data on user behavior, including logs of visits to specific pages and/or content. This data will be used solely to improve services and tailor promotional activities to individual user needs.

The seller commits to protecting users’ personal data in accordance with the Personal Data Protection Act and will not share data with third parties without the user's consent (except for data necessary for delivery by business partners).

Exceptions apply when the seller is legally obligated to provide or allow access to personal data by authorized government bodies.

Automatically recorded data that is not personal—such as browser type, number of visits, time spent on the site—may be used solely to assess site traffic and improve content and functionality.

The user/buyer has the right to request the addition, correction, or modification of inaccurate personal data. If the seller is not informed of changes, it is not liable for any issues with the order or delivery.

The above data protection provisions apply only to pages within the www.fjk-no1.hr domain, not to external sites accessed via links from this domain.

Giana d.o.o., Zagreb, Grada Chicaga 27, OIB: 54809880189, represented by director Sandro Rinčić, as the data controller, provides this Information on Data Protection regarding the processing of personal data and rules related to the free movement of personal data, as it is subject to the provisions of the General Data Protection Regulation (EU) 2016/679 of April 27, 2016 (hereinafter: GDPR).

The data controller will take all measures to protect personal data from breaches during processing, including all legitimate, technical, personnel, and organizational measures to safeguard personal data from any unauthorized processing, whether external (by subcontractors, suppliers, other service users, unauthorized third parties) or internal, and will fully comply with the requirements and principles of the GDPR.
